The prices and availability indicated in this catalog are intended as long as stocks last and are subject to changes due to market or other reasons. Discounts, coupons and promotions are never combined. The images shown on the website www.farmaciaitalia.it are entirely indicative and may differ significantly from the product actually available.

All the contents of the website www.farmaciaitalia.it (texts, images, photos, drawings, descriptions, etc ...) are to be considered of an exclusively informative nature, aimed at bringing to the attention of customers, or potentially such, the products sold by Farmacia Di Gangi sas and have no advertising character or nature in any way.

Validity of prices and order confirmation via email

By submitting the order form you will receive an automatic order confirmation by email. This order confirmation has the sole purpose of notifying the receipt of the electronic order and does not constitute formal acceptance of the order. The price applied will be the one fixed at the time of the order. However, it is possible that some offers or items have in the meantime sold out or have undergone particularly significant price changes. In this case we reserve the right to contact you as soon as possible to cancel the order (without penalties for both parties) and possibly offer you an alternative product.

Responsibility

It is understood that Farmacia Italia assumes no responsibility for the use that the customer intends to make of the purchased goods. In the event of defective or non-functioning goods, Farmacia Italia will have the sole burden of repairing or replacing it at its discretion. In no case Farmacia Italia will be held responsible for lost earnings due to the inability to use the products purchased.

Order fulfillment

Unless otherwise indicated, we reserve the right to send the available products and subsequently the products not in stock without further charges for the customer. If, on the other hand, the partial evasion is explicitly requested by the customer, he will have to bear the burden of the additional shipment.

The lack of products or parts of them in the package or their possible damage during transport must be declared within 2 days of receipt of the package (also by email).

At the time of delivery of the goods by the courier, the Customer is required to check that the packaging is intact in all its parts, not damaged or wet or in any case altered in the closing materials, in which case he must immediately challenge the courier who makes the delivery of any damage, by putting a "goods control reserve" on the accompanying document (counter-signed by the courier himself) and declare everything via email to FarmaciaItalia.

In case of attempted delivery of a tampered package, the same must be refused after verification of the contents.

Delivery methods and times

Farmacia Italia ships by GLS express courier, which has always offered a fast and guaranteed service.

The average shipping times are 2-4 working days (Saturdays, Sundays and holidays excluded), but these may vary due to force majeure such as weather conditions and strikes.

Deliveries are made from Monday to Friday, during normal office hours, excluding national holidays, by delivering the products to the address specified when placing the order.

It is very important, during the purchase phase, to indicate a valid email address, in order to allow the courier to communicate the taking charge of the shipment and thus optimize the delivery methods.

Your package can be stored for up to 14 days. On the 7th day a new reminder email is sent and on the 13th day a further email inviting the collection. On the 15th day the package is returned to the sender for complete storage.

By using the fermopoint collection points service, it is not possible to pay cash on delivery.

Return of goods and right of withdrawal

If the Customer is a "consumer" (ie a natural person acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out), he has the right, pursuant to and for the purposes of the updated Legislative Decree 206/2005 by the Consumer Code in implementation of Directive 2011/83 / EU on consumer rights in force since June 14, 2014, to withdraw from the Sale and Purchase Agreements within 14 days from the date of receipt of the Products covered by the Sale and Purchase Agreements. The right of withdrawal must be exercised by the Customer by sending a written communication to Farmacia Italia, by e-mail to the address indicated on the Contact page, containing:

- the manifestation of the will to make use of the right of withdrawal;

- the indication of the order number that gave rise to the Sale and Purchase Agreement from which it intends to withdraw.

In case of exercise by the Customer of the right of withdrawal:

- the Customer must return the Products within 14 days from the date of the notice of withdrawal;

- all costs related to the return of the Products are entirely borne by the Customers;

- Farmaciaitalia undertakes to reimburse the Price as soon as possible, and in any case within 14 days from the date of receipt of the notice of withdrawal provided that:

- the products have been returned and are intact;

- the original packaging / packaging of the products is also returned and the same is intact;

- any accessories are also returned and they are intact;

- the products have not been used in a manner other than that necessary to establish their nature, characteristics and functioning;

Farmaciaitalia will communicate to the Customer the methods of reimbursement of the price and may, for this purpose, ask the Customer for his / her bank details (IBAN and account holder).

In the event that the product is deteriorated or damaged Farmaciaitalia will refund the product anyway, but at the price decreased by the depreciation caused by the customer.

The Customer acknowledges that the withdrawal of the Product is a specific obligation deriving from the purchase contract.

In the event that the package is refused, the customer will be charged for the shipping costs and all additional costs for returning it to the sender.

In case of non-delivery due to the absence of the recipient at the address specified in the order form, after two failed delivery attempts, the package will go "in storage" at the courier's office. In the event of failure to collect the Product within five working days of the first delivery attempt, the contract will be considered terminated and the purchase order consequently canceled pursuant to art. 1456 of the Italian Civil Code Once the contract is terminated, the reimbursement of the total amount possibly paid by the Customer will take place, less the costs of unsuccessful delivery of the Product and the return costs.

The termination of the contract and the refund amount will be communicated to the Customer via e-mail.

Exceptions to the Right of Withdrawal:

The right of withdrawal cannot be exercised:

a) in the case of the purchase of medicines and medical devices;

b) in the case of the purchase of food, beverages and other goods intended for daily consumption;

c) in the case of purchases of less than 50 euros (unless the overall consideration that the consumer must pay regardless of the amount of the individual contracts exceeds 50 euros);

d) in the case of a contract concerning a service after the complete provision of the service if the execution of the contract began with the express agreement of the Consumer;

e) in case of supply of goods made to measure or clearly personalized;

f) in the case of supply of goods which risk deteriorating or expiring rapidly;

g) in the case of the supply of sealed goods which are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery;

h) in the case of supply of goods which after delivery are by their nature inseparably mixed with other goods.
